Hurley International filed a patent infringement lawsuit against Old Navy last Thursday, August 2. Hurley is accusing the company of exploiting patented technology used to make the material of the very successful Phantom boardshorts.
Hurley patented the technology used in the making of the Phantoms, which have received several awards since their release back in 2007. As with any successful product, there is bound to be a result of replication by competitors. Old Navy came out with a line of shorts called Solid, which are very similar to Hurley’s Phantom short.
Hurley has requested an injunction against Old Navy to end all production of shorts made with this material. They are also demanding compensation for all damages due to this infringement.
A pair of Hurley Phantoms may run from $55 to $125, while Old Navy Board Shorts have sold for $10 to $17.
